That link would not have been "perfect" if Plummer was on my roster.  I realize Troy is making sure he doesn't rule in his own favor, but it is setting a precedent.
I am not an attorney. Nor am I looking to get Troy out of his fine, but I do not see where this is an "arrest".  It is a summons to appear due to a traffic incident.  An arrest would imply potential jail time and posting of bail. Neither of which has been explained, nor mentioned, in what I have read. If it is determined to be a "hit-and-run" which is a "criminal" offense in most US states, then that would satisfy me.  But so far it appears as a traffic accident with property damage.  The "victim" claims he kicked in the head light.  It is not clear that the summons says this. He got a ticket (summons) because it has been alleged he was in the wrong.  But was he ARRESTED?? If the jail bird fine is to be extended to speeding tickets, traffic violations and spitting on the sidewalk, all of which are against state or municipal law, then we all may as well put up the $ now.  I do not think the intent of the JB fine was to apply to breaking any law.  Or was it?
I might agree Plummer owner appears guilty and may pay fine, but has the right to an appeal.

After seeing how the whole season played out with the Jail Bird fine feature, I was going to suggest next season that the money goes to the team, or teams, that did not get any jail bird fines. But if the definition is this loose, there will be no completely clean rosters.

at 1st i didn't think i was going to get fined because it was a summons for a traffic violation so he wasn't arrested or charged with anything
but with the link that sat provided, plummer pleaded " not guilty" to a state law.
therefore i assume if he pleaded not guilty he must have been charged with something

I consulted with an attorney friend,  the part that reads:
"Plummer was issued a summons to face a misdemeanor violation of "injure or destroy property," similar to criminal mischief under state law." is slightly more severe than a traffic summons.  He likened it to getting caught bashing mail boxes, or egging a house.  However, those "criminal mischief" type offenses usually involve an arrest.  I have yet to read anywhere where it says he was ARRESTED.  Are they intentionally leaving the "arrest" word out of the story?  I don't think so.  The media would emblazen the headline with PLUMMER ARRESTED.  I think they are not using the word "arrested" because he was not.  I think that is the litmus test for our little game.  Drew was arrested. Droughns was arrested. Santonio Holmes was arrested. And every report said so.  But no report has used the "arrested" word with Plummer.

As much as misery likes company, and I'd like to the JB pot swell, I would vote this a "not a jail bird fine offense".

so arrested or not, he was charged, which is our rule.........i asked troy abou this earlier, on whether it matters if they are guilty or not guilty and he said no, as long as they are charged.

The Associated Press reports that Steelers receiver Santonio Holmes was arrested early Monday for domestic violence.

The arrest came just after midnight.  Holmes was taken to the Franklin County (Ohio) jail.  His first court appearance is scheduled for Tuesday.  The police aren't giving out any details as to who has made the complaint or what Holmes allegedly did.

I thought there was no double jeopardy in this. Holmes has already had his arrest for the year on May 27.  I thought you could only get fined once per year on a particular player.

This is the rule as written in the constitution. I will discuss with Troy when he gets back.

it's pretty clear cut.....one per offence.....not one per year.........i think what it is meant is like when you get arrested for something, then get another charge added on for the same crime, that will only be considered one, not two..........that's what I remember asking Troy also when he first came up with this rule, but I could have it wrong.

Next question,  What about having the charges dropped, like Drew?  Aren't the police admitting it was a mistake to arrest him in the first place?  Or did the victim drop the charges (get bought off)?
This is different than being found innocent at trial.

The way the rule is worded there is nothing i can do because he was arrested (so that is 1 of the stipulations)

Bengals' Henry arrested for third time since December

The troubled offseason of Cincinnati Bengals wide receiver Chris Henry has continued, with the one-year veteran arrested early Saturday and charged with speeding and operating a vehicle under the influence (OVI), the Ohio State Highway Patrol has confirmed.

The arrest is the third since December for Henry, who was already facing possible league sanctions under the terms of the NFL personal conduct policy. Henry is also the second Bengals player arrested this week. Rookie linebacker A.J. Nicholson, a fifth-round selection in the April draft, was charged Saturday with burglarizing the apartment of a former Florida State teammate.

Sgt. Kevin Long of the Ohio State Highway Patrol said Henry was stopped on Interstate 275, on the east side of Cincinnati, at 1:18 a.m., after being clocked driving 82 mph in a 65 mph zone. Because officers detected the odor of alcohol, a field sobriety test was conducted, and Henry was subsequently transported to the Milford, Ohio police station.

Long said that Henry registered a .092 reading on the blood-alcohol test. The legal limit in Ohio is .08.

"Mr. Henry agreed to the test and he was polite, courteous and cooperative the entire time," Long said, citing the police report. "He was issued a traffic citation and he [eventually] left with a friend. There was no bail involved and he was issued a court date."

Henry is scheduled for a Friday appearance in Clermont County Municipal Court. The speeding charge, Long said, is a minor misdemeanor. The OVI charge is a first-degree misdemeanor. Any fines or further sanctions resulting from the incident will be determined by the court.

Citing club policy, Bengals public relations director Jack Brennan on Sunday afternoon declined comment on the Henry arrest.

Henry, 23, faces a felony gun charge in Florida stemming from a Jan. 29 incident in which he allegedly possessed a firearm outside an Orlando nightclub. Henry is charged with possession of a concealed firearm in that incident, a third-degree felony in Florida, punishable by up to five years in prison and a $5,000 fine. Two other charges from that incident, aggravated assault with a deadly weapon and improper exhibition of a weapon, were dropped.

Bengals LB Odell Thurman was arrested at 3:05 a.m. today and charged with driving under the influence of alcohol. Thurman registered a .17, said Officer Stephen Lawson of the Cincinnati Police Traffic Section. Under Ohio law, a person is presumed intoxicated at .08 percent blood alcohol content. Thurman was one of several Bengals players in Thurman's 2007 Chevrolet Tahoe. That was a publicity stunt.  Since he didn't get to go on the "sex" cruise last year and he was basically obscure all season, he needed to get his name in the papers somehow.  Personally I hope he gets fired and gets picked up by Atlanta, so I can drop his sorry ass.
